A TRIP to the gym left Robert Gordon University pharmacy student, Anthony McDavitt, feeling anything but fit, after a car reversed out of a kerbside parking place and directly into his path.
Begins a spokesperson: “Anthony, 21, who was cycling at the time as part of his fitness training ploughed straight into the side of the car that pulled out in front of him, wrecking his bike and landing dazed and confused on the road.
“Now, Thompsons Personal Injury Solicitors have helped him win nearly £16,000 in compensation for his injuries which included a broken wrist, smashed teeth, cuts and bruises.”
Anthony who comes from Plains, Airdrie in Lanarkshire, was living in a flat near Holburn Street in Aberdeen City Centre. The accident happened on Holburn Street near Balmoral Court.
He said: “The car was parked nose onto the kerb, but it suddenly reversed out just as I was about to pass.
“It was just after 7.00am and I was heading for the Robert Gordon Sports Centre to spend an hour or so in the gym before starting my studies.
“I reckon I was doing about 25 miles per hour, but it happened so quickly I was left with nowhere to go, other than run right into the car.
“The force of the collision meant the front of the bike was a total write off, with bent forks and a mangled front wheel.
“I don’t know if I was knocked out for a few seconds but I was so dazed and confused I tried to get onto the bike and ride off, despite the state it was in.
“Needless to say, it was a couple of months before I saw the gym again.”
Roz Galloway of Thompsons Solicitors, Aberdeen, who fought his case, said: “The car driver’s insurance company tried to argue that Anthony was to blame for the crash, despite the fact that the vehicle reversed into his path.
“But we stuck to our guns and they eventually agreed to an out of court settlement.”
Anthony added: “I am delighted with the settlement, and I am back in training. My wrist is still a bit still sore when I lift weights but I hope that will go with time.”
